EU Settlement Scheme (EUSS)

Straightforward settled status, pre-settled status and family permit applications.

For EU, EEA and Swiss citizens and their eligible family members whose rights come from residence in the UK before the end of the transition period.

The EU Settlement Scheme is not open to every EU citizen or family member simply because of nationality. Eligibility depends on residence in the UK before the end of the transition period, or on a family relationship with someone who qualifies, and on the dates involved.

Check your digital status

Pre-settled status has been extended automatically in recent years, and some holders have been moved to settled status without applying. Check your UKVI account rather than assume, and take advice before long travel or an application for settled status.

Late applications that depend on showing reasonable grounds, refusals and anything involving an administrative review or appeal may need an adviser authorised at a higher level. Eligibility depends on your individual circumstances and residence or family history, and we will tell you if your matter needs referral.

What we can and cannot help with

We provide advice and application assistance for straightforward immigration matters within our IAA Level 1 Immigration authorisation. Where a matter falls outside that authorisation — for example because it involves adverse immigration history, a discretionary or human-rights claim, an administrative review, an appeal or tribunal work — we will tell you and signpost or refer you to an adviser authorised at the appropriate level.

If an application is refused, we will explain the decision and whether any further work remains within our Level 1 authorisation. Where an administrative review, an appeal or other higher-level casework is needed, we will signpost or refer you to an appropriately authorised adviser. We do not provide appeal or tribunal representation.

UK Visas and Immigration (UKVI) makes the final decision on every application. No immigration adviser can guarantee that an application will be approved.

Questions clients often ask

Can I still apply to the EU Settlement Scheme?

The main deadline passed in 2021. Family members joining someone with status can still apply in the circumstances the rules allow, and late applications are accepted only where there are reasonable grounds for the delay. A late application that turns on reasonable grounds may need an adviser authorised at a higher level, and we will tell you if yours does.

How do I move from pre-settled to settled status?

Normally by completing a continuous qualifying period of residence and then applying for settled status. Pre-settled status has been extended automatically in recent years and some holders have been moved to settled status without applying, but do not rely on that alone — check your UKVI account and apply where you are eligible.

Can my non-EU family member join me?

Depending on when the relationship began and on your own status, an EUSS family permit or a scheme application may be available. The rules distinguish sharply between relationships that existed before the end of the transition period and those formed afterwards, so the date matters as much as the relationship.
